1. Introduction

Welcome to DestanArt. These Terms and Conditions (“Terms”) govern your access to and use of DestanArt.com (the “Website”), including the purchase and sale of digital artwork and use of the D-Credit system.

DestanArt operates as an online visual arts marketplace connecting independent artists and sellers (“Sellers”) with customers and buyers (“Buyers”).

By accessing the Website, registering an account, purchasing digital content, listing artwork for sale or otherwise using the platform, you confirm that you have read, understood and agreed to these Terms, together with our Privacy Policy, Cookie Policy and other applicable policies.

If you do not agree with these Terms, you must not use the platform.


2. Accounts

2.1 Registration

To purchase products, use D-Credit or sell artwork through DestanArt, users may be required to create an account.

You agree to:

  • provide current, complete and accurate registration information;
  • maintain accurate account information;
  • keep your login credentials confidential;
  • use only accounts and payment methods you are authorised to use; and
  • notify DestanArt promptly if you suspect unauthorised access to your account.

Different account functions may be available to Buyers and Sellers.

2.2 Eligibility

The Service is intended for users who are at least 18 years old.

By registering an account or using the platform, you represent that you are at least 18 years of age and legally capable of entering into a binding agreement.

2.3 Account Security

You are responsible for maintaining the confidentiality of your password and for activity conducted through your account.

DestanArt may temporarily restrict or suspend an account where reasonably necessary for security, fraud prevention, legal compliance or protection of other platform users.


3. Buyer and Seller Accounts

DestanArt provides a marketplace through which Buyers can discover and purchase digital artwork offered by independent Sellers.

Sellers may use authorised Seller/Vendor functionality to create listings and offer eligible digital artwork through the platform.

Buyers and Sellers remain responsible for ensuring that information provided through their accounts is accurate.

DestanArt may establish reasonable account, verification, content and transaction requirements for different types of users.


4. User Conduct

Users must not:

  • upload, sell or distribute illegal or prohibited content;
  • upload content that unlawfully infringes copyright, trademark, privacy or other third-party rights;
  • provide false or misleading information;
  • use stolen or unauthorised payment information;
  • engage in fraudulent purchases or sales;
  • manipulate reviews, transactions or platform functionality;
  • interfere with Website security;
  • introduce malware or malicious code;
  • attempt unauthorised access to another account;
  • use the platform for money laundering or other unlawful financial activity;
  • abuse refunds, D-Credit, payment processes or promotional systems.

DestanArt may restrict, suspend or terminate accounts that violate these requirements.


5. Intellectual Property

Website content owned or licensed by DestanArt, including original text, graphics, branding, layout and software, is protected by applicable intellectual property laws.

Artwork uploaded by independent Sellers remains subject to the intellectual property rights of the relevant Seller or other lawful rights holder.

By uploading or listing artwork, a Seller represents and warrants that they:

  • own the relevant rights to the artwork; or
  • possess sufficient licences, permissions or other legal authority to offer the artwork through DestanArt.

Sellers must not upload or sell content that infringes the rights of another person.

If you believe content available through DestanArt infringes your intellectual property rights, contact:

DestanArt may investigate infringement reports and remove or restrict content where appropriate.


6. AI-Generated and AI-Assisted Artwork

DestanArt may permit Sellers to list artwork created or assisted using artificial intelligence tools, subject to applicable law and platform requirements.

Sellers offering AI-generated or AI-assisted content are responsible for ensuring that:

  • they have the necessary rights to commercially offer the content;
  • the content does not unlawfully infringe third-party intellectual property rights;
  • the listing does not falsely represent the origin or authorship of the work;
  • AI-generated or AI-assisted content is identified where required by DestanArt or applicable law;
  • any software, model, source material or other resource used in producing the work was used in accordance with applicable terms and legal requirements.

DestanArt may request additional information regarding the origin, creation or licensing of artwork where reasonably necessary.

DestanArt may remove content where there is reasonable evidence of intellectual property infringement, unlawful content, misleading representation or violation of platform requirements.


7. Multivendor Marketplace and Seller Cooperation

DestanArt operates as a platform facilitating transactions between independent Sellers and Buyers.

Sellers are responsible for:

  • creating accurate product listings;
  • providing accurate descriptions and preview images;
  • setting prices where Seller pricing functionality is available;
  • ensuring that uploaded files correspond to the advertised artwork;
  • ensuring they possess the necessary intellectual property and commercial rights;
  • complying with applicable laws;
  • responding reasonably to legitimate order or product issues;
  • complying with DestanArt marketplace rules.

By listing artwork through DestanArt, the Seller grants DestanArt the limited rights reasonably necessary to host, display, reproduce previews of, market and technically distribute the listed content for the purpose of operating the marketplace and facilitating sales.

This permission does not transfer ownership of the Seller’s underlying intellectual property to DestanArt.

Seller content may be removed or restricted where it violates these Terms, applicable law, intellectual property rights or platform policies.


8. Seller Verification and Content Moderation

DestanArt may require Sellers to complete reasonable account or identity verification procedures before or during use of Seller functionality.

DestanArt may review listings for compliance with marketplace requirements.

Users may report:

  • illegal content;
  • suspected copyright infringement;
  • fraudulent listings;
  • misleading product descriptions;
  • prohibited content;
  • suspicious activity.

Reports may be submitted to:

DestanArt will review reports within a reasonable period and may remove content, restrict listings or suspend accounts where appropriate.


9. Seller Fees and Platform Commission

DestanArt may charge Sellers platform commissions, transaction fees or other charges associated with marketplace services.

Any applicable commission, fee or deduction will be communicated to the Seller through the applicable Seller interface, agreement, transaction information or other relevant platform disclosure.

Sellers are responsible for reviewing applicable fees before offering products through the platform.

DestanArt will not impose undisclosed transaction charges on completed Seller transactions.


10. Seller Relationship and Termination

Sellers operate independently and are not employees of DestanArt merely because they use the marketplace.

Either DestanArt or the Seller may terminate the Seller relationship in accordance with the applicable platform terms and legal requirements.

DestanArt may suspend or terminate Seller access immediately where reasonably necessary because of:

  • fraud;
  • illegal activity;
  • intellectual property infringement;
  • serious or repeated policy violations;
  • payment abuse;
  • security risks;
  • legal or regulatory requirements.

Where a Seller relationship is terminated, outstanding orders, valid Buyer claims and any legitimate outstanding Seller balance will be handled in accordance with applicable platform procedures and law.


11. Product Listings and Digital Artwork

Sellers must provide Buyers with sufficient information to understand the digital product before purchase.

A listing should provide relevant information such as:

  • artwork description;
  • digital format where applicable;
  • licence or permitted use where applicable;
  • relevant restrictions;
  • whether the artwork is AI-generated or AI-assisted where disclosure is required;
  • price;
  • other material characteristics of the product.

Buyers are responsible for reviewing the listing before purchasing.


12. D-Credit Wallet System

DestanArt uses a platform credit system known as D-Credit.

D-Credit allows eligible users to maintain platform credit within their DestanArt account and use that credit for eligible purchases and transactions available through DestanArt.

The available D-Credit balance can be viewed through the relevant account or wallet section.

D-Credit:

  • is intended for use within the DestanArt platform;
  • does not constitute a bank account;
  • does not constitute a deposit account;
  • does not accrue interest;
  • cannot be used for unlawful or fraudulent activity.

DestanArt does not provide a customer-to-customer or third-party Wallet Transfer function.

Users cannot use the D-Credit system to transfer their wallet balance to another customer through the platform.


13. D-Credit Top-Up

Where available, users may purchase or add D-Credit through the Wallet or Top-Up functionality provided within their account.

The normal process is:

  1. Log in to the DestanArt account.
  2. Open the Wallet or D-Credit section.
  3. Select the available top-up option.
  4. Enter or select the desired top-up amount.
  5. Review the amount and applicable currency.
  6. Continue to the available payment process.
  7. Complete any required payment authentication.
  8. Following successful payment confirmation, the corresponding D-Credit is credited to the user’s account.

Users are responsible for reviewing the amount before confirming a top-up.

D-Credit becomes available after the relevant payment has been successfully processed and confirmed.

Top-ups may be subject to transaction verification, fraud prevention, payment security and compliance procedures.


14. GaliaPay Card Payments for D-Credit Top-Ups

Bank card payments used to purchase or top up D-Credit are processed through GaliaPay, the payment provider used by DestanArt for eligible card-based D-Credit top-up transactions.

When a user initiates a D-Credit top-up, the user selects the desired amount and proceeds to the payment process.

The applicable card transaction is processed through GaliaPay’s payment environment.

The transaction may be subject to:

  • card authorisation;
  • payment verification;
  • fraud prevention checks;
  • transaction monitoring;
  • authentication procedures;
  • other payment-provider requirements.

Following successful payment confirmation, the corresponding amount of D-Credit is credited to the user’s DestanArt account.

A failed, declined or unconfirmed card transaction will not normally result in D-Credit being added to the account.

DestanArt does not intentionally store complete payment card numbers or card security codes on its Website servers where these details are handled directly by the payment provider.


15. Purchasing Artwork with D-Credit

Eligible artwork available through DestanArt may be purchased using available D-Credit.

To complete an eligible purchase:

  1. Log in to your account.
  2. Select the desired artwork.
  3. Review the product information and price.
  4. Proceed to the applicable purchase or checkout process.
  5. Use the available D-Credit balance.
  6. Review and confirm the transaction.
  7. Complete the order.

The user’s D-Credit balance must be sufficient to cover the required purchase amount.

If the available D-Credit balance is insufficient, the user may be required to add additional D-Credit through the available top-up functionality before completing the purchase.


16. No Partial Prepayments

DestanArt does not accept partial prepayments for product orders.

The full amount required for an order must be covered by the customer’s available D-Credit balance before the purchase can be completed and the digital artwork made available.

A customer cannot reserve or partially purchase an artwork by paying only part of the required purchase price.

Where the available D-Credit balance is insufficient, the customer must first obtain sufficient eligible D-Credit through the available top-up process.


17. Taxes

Applicable VAT, sales tax or other taxes may be calculated or included where required by law.

Where a tax applies to a transaction, relevant tax information will be displayed or processed in accordance with applicable requirements.

Sellers remain responsible for their own tax obligations, including income reporting, registration requirements and other Seller-specific tax obligations applicable in their jurisdiction.

DestanArt does not provide individual tax advice.


18. Digital Delivery

DestanArt primarily supplies digital artwork electronically.

Unless a listing expressly states otherwise, no physical product is shipped and no physical shipping address is required for delivery.

After successful completion of an eligible purchase, the digital product may be made available through:

  • the customer’s account;
  • the relevant order page;
  • a secure digital download;
  • another electronic delivery method provided by the platform.

A billing address or other payment-related information may still be requested when necessary for payment verification, taxation, invoicing, fraud prevention or regulatory purposes.


19. Downloading Purchased Artwork

Purchased digital artwork may be accessible through the relevant area of the customer’s DestanArt account.

Customers are responsible for:

  • maintaining access to their account;
  • protecting downloaded files;
  • following applicable licence conditions;
  • not distributing or reselling files where such use is not authorised.

Customers should contact DestanArt if an eligible completed purchase is not available for download as expected.


20. Consumer Cancellation Rights for Digital Content

Digital artwork supplied through DestanArt constitutes digital content.

Where applicable consumer law provides a statutory cancellation or withdrawal period, customers may be asked to provide express consent for immediate supply of the digital content.

Where permitted by applicable law, customers may also be required to acknowledge that their statutory cancellation or withdrawal right may be lost once digital supply or downloading begins.

Nothing in these Terms removes or limits any mandatory consumer right that cannot lawfully be excluded.


21. Returns, Refunds and Faulty Digital Content

Refunds and other remedies are governed by DestanArt’s dedicated Return and Refund Policy and applicable consumer protection law.

A successfully supplied or downloaded digital product is not automatically refundable merely because the Buyer changes their mind.

However, this does not remove statutory rights where digital content:

  • is faulty;
  • is materially different from its description;
  • was not supplied as agreed;
  • cannot be accessed because of a problem attributable to the supplied product or platform;
  • otherwise qualifies for a mandatory remedy under applicable law.

Depending on the circumstances, an appropriate remedy may include redelivery, replacement, technical assistance, price reduction or refund.


22. Buyer and Seller Disputes

If a dispute arises between a Buyer and Seller, the parties should first attempt to resolve the issue reasonably.

Where direct resolution is unsuccessful, the matter may be reported to DestanArt at:

The complaint should include relevant information such as:

  • order number;
  • description of the issue;
  • relevant communications;
  • screenshots or supporting evidence;
  • other information reasonably necessary to investigate the matter.

DestanArt may review the available evidence and assist with resolving marketplace disputes in accordance with applicable platform policies and law.

Nothing in this process prevents a consumer from exercising mandatory legal rights or using an available external dispute-resolution mechanism.


23. Fraud Prevention and Transaction Security

DestanArt may apply reasonable security measures to accounts, D-Credit top-ups and marketplace transactions.

These measures may include:

  • transaction monitoring;
  • account verification;
  • payment verification;
  • fraud screening;
  • unusual-activity detection;
  • temporary transaction holds;
  • requests for additional information where reasonably necessary.

DestanArt may delay, reject, restrict or review transactions where there is reasonable evidence of fraud, unauthorised payment activity, account misuse or another security concern.


24. Platform Transparency

DestanArt aims to provide Buyers and Sellers with clear information concerning marketplace transactions.

Where ranking or recommendation systems are used, factors may include relevant criteria such as:

  • product relevance;
  • Seller performance;
  • pricing;
  • customer engagement;
  • reviews or ratings;
  • listing quality.

The exact importance of individual factors may vary depending on the relevant Website feature.

DestanArt may update ranking systems to improve relevance, security or marketplace quality.


25. Content Moderation

DestanArt may investigate and take action against content that:

  • is illegal;
  • infringes intellectual property rights;
  • contains fraudulent or misleading information;
  • violates these Terms;
  • presents security or compliance concerns.

Depending on the circumstances, action may include:

  • removing a listing;
  • restricting visibility;
  • requesting additional information;
  • suspending Seller functionality;
  • suspending or terminating an account.

26. Third-Party Services

DestanArt may rely on third-party providers for services including payment processing, hosting, security, analytics and technical functionality.

Third-party services may be subject to their own terms and privacy practices.

The use of GaliaPay for eligible card-based D-Credit top-ups does not make GaliaPay the Seller of artwork offered through the DestanArt marketplace.


27. Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including mandatory consumer rights.

To the maximum extent permitted by applicable law, DestanArt is not responsible for indirect or consequential losses arising from:

  • misuse of the Website;
  • unauthorised disclosure of account credentials;
  • Seller content that DestanArt could not reasonably have known was unlawful;
  • circumstances outside DestanArt’s reasonable control;
  • third-party service interruptions not caused by DestanArt.

Nothing in this section removes any remedy or protection that applicable consumer law requires DestanArt to provide.


28. Indemnification

To the extent permitted by applicable law, Sellers agree to be responsible for claims arising from content they upload or sell where the claim results from:

  • infringement of third-party intellectual property rights;
  • unlawful content;
  • false representations regarding ownership or licensing;
  • violation of applicable law;
  • material breach of these Terms.

This provision does not apply where liability is caused by DestanArt’s own unlawful conduct or where applicable law provides otherwise.


29. Privacy and Data Protection

Personal data is processed in accordance with DestanArt’s Privacy Policy and applicable data protection laws.

This may include the UK GDPR, the EU GDPR where applicable, and other relevant privacy legislation depending on the user and transaction.

Payment-related information processed by payment providers may also be subject to the relevant provider’s privacy and security practices.


30. Changes to These Terms

DestanArt may update these Terms where reasonably necessary because of changes to:

  • applicable law;
  • marketplace functionality;
  • D-Credit functionality;
  • payment processing;
  • Seller features;
  • security requirements;
  • business operations.

Material changes will be communicated where required by applicable law.

The current version will be published on the Website with an updated revision date.


31. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, subject to any mandatory consumer right to rely on the laws or courts of the consumer’s country of residence where applicable.

Nothing in these Terms deprives consumers of mandatory protections that cannot lawfully be excluded.
